Settlement reached in Appell vs. Llano County

Llano County Commissioners Friday at a special called meeting announced that a settlement agreement has been reached in the matter of Shirley Appell vs. Llano County.
The settlement was arrived at during mediation on June 20 and the final terms are pending the approval of the commissioners court, which is expected to vote on it at a future meeting.
The consideration to be given for this settlement is that Llano County will pay $212,500 plus up to $2,000 in documented court costs to the plaintiff; in exchange for a full release of all defendants in the suit. The settlement includes numerous non-monetary terms as well, which reflect the plaintiff’s concerns regarding the jail, according to County Judge Wayne Brascom.
The county will pay the monetary settlement at some point in the future, Brascom said.
Shawn Michael Appell, 45, of Llano was found dead and alone in a cell around 5:35 p.m. on Aug. 6, 2011 after repeatedly hitting his head against the concrete in the cell until he died, according to autopsy results at the time.
The two jailers, Donny Stewart and Scottie Scoggins, entered no-contest pleas in May to misdemeanor charges related to Appell’s death. Both were sentenced to time in jail and to perform community service in a facility that deals with the mentally ill.
